Dear Texas Public Utility Commission,
I strongly oppose Blackstone’s proposed acquisition of TXNM Energy (Docket 58536). This purchase threatens Texas’ energy independence, affordability, and reliability. Texas utilities should be guided by Texans, not Wall Street. Please vote NO on this takeover.
However, should the Commission approve this acquisition, I urge you to immediately modernize §25.173 to protect ratepayers and ensure grid reliability. The rule was written for a different era and no longer reflects today’s reliability challenges. Transmission costs have soared, weather-dependent generation has grown far beyond original expectations, and generators are not required to maintain adequate dispatchable capacity.
A revised §25.173 must include:
• A minimum dispatchable generation requirement—at least 60% firm power unless reliability can be guaranteed otherwise.
• Ratepayer-protective cost allocation so families are not forced to absorb the costs of remote renewable buildout or poor siting decisions.
• Annual transparency and reliability reporting to ensure generation portfolios support a resilient grid.
Updating §25.173 is the most direct way to safeguard Texas consumers and maintain a strong, reliable energy mix, especially if private equity firms acquire utilities without firm-capacity obligations.
